The representation is civil legal relationship that arises between representative and the one who’s being represented. Individuals can conduct their cases in court either by themselves or through their representatives. The agent may be instructed to perform the following procedural legal acts: write an appeal, to participate in proceedings and the like. Representation is understood as a person’s action in court on behalf of other person.

According to the binding of representatives, representing can be distinguished:

 

1)Necessary (eg, when there is a legal person);

2)Optional (Optional or voluntary) – a party may plead the case itself, but some of them gets a representative.

The representatives of the individuals are required by law to submit to the court documents, confirming their rights and obligations.

Representatives in court can be:

1)Lawyers

2)advocates with written authorization to represent in a particular case;

3)one of the accomplices assigned by other accomplices;

4)persons who have a university degree in law, provided that they represent their close relatives or spouse (partner);

5)trade unions, if they are represented by trade union members in labor relations matters.

Representatives in court can’t be:

 

1)The judges, unless they are the representatives by the law;

2)the prosecution, unless they are the representatives by the law;

3)persons who are under guardianship or trusteeship;

4)persons to whom such right is restricted by law.

Representation is important for two reasons:

 

1)Litigation is an activity that requires special legal knowledge.

2)In some cases, without agent the case can’t be examined.

According to representatives of the binding participation and representation can be distinguished:

1)Mandatory;

2)Optional (or voluntary basis).

Legal person in court proceedings is represented by legal person’s organs or members, acting within the law, rights and obligations written down in their instruments of incorporation.

Representatives in accordance to permission in the court may be:

 

1)Lawyers

2)Advocate assistants with written authorization to represent a particular case;

3)Accomplice by other accomplices permission ;

4)Person who has a university degree in law, provided that they represent their close relatives or spouse (partner);

5)Trade unions, if they are represented by trade union members in labor relations matters.

Representatives in the court can’t be:

 

1)The judges, unless they are the representatives by law;

2)The prosecutors;

3)Persons who are under guardianship or trusteeship;

4)Persons to whom such right is restricted by law.
