Spouses may apply to the court
One of the spouses may submit a request to the court for approval of separation by living apart:
- if due to certain circumstances — even if not attributable to the other spouse —
their cohabitation has become intolerable (impossible), - or if it could fundamentally harm the interests of their underage children,
- or if the spouses are not interested in continuing their joint life together.
Separation by Living Apart in Lithuania
Both spouses may submit a joint request to the court for the approval of separation by living apart if they have concluded an agreement concerning the consequences of such separation. This agreement must specify matters related to the residence of their underage children, child support and upbringing, the division of marital property, and mutual maintenance obligations.
